Only you can decide the best course of action for your business. Success Beyond Luck cannot and will not manage or supervise your business on your behalf.

A coaching relationship is different than the services provided by a consultant. Consultants assess business situations and recommend solutions. A coach helps you assess your own situation and develop your own solutions. This will likely require you to strengthen your business knowledge and skills through learning and practice. 

Coaching is not therapy, counseling, or any medical treatment. Your coach is not a health care professional nor legal professional. 

Warranty Information 

The information, services, products, claims, seminar topics, and materials on this site are provided “as is” and without warranties of any kind, either expressed or implied. Success Beyond Luck disclaims all warranties, expressed or implied, including but not limited to implied effectiveness of the Services listed on this site.

The only exception is the guarantees of satisfaction and graduation that are clearly labeled guarantees within our written service agreements. Neither Success Beyond Luck nor any of our respective licensors or suppliers warrant that any functions contained in the websites will be uninterrupted or error-free, that defects will be corrected, or that the website or the server that makes them available are free of viruses or other harmful components.

Limitation on Amount of Damages

In no event will the liability of either of us to the other exceed the total amount of fees proposed to be paid for services.

Limitation on Type of Damages

Except for the damages which are the result of (i) a breach by either of party of their obligation of confidentiality to the other, or (ii) your infringement of our intellectual property rights, in no event will either party be liable to the other for special, incidental, consequential, indirect or punitive damages, including lost profits.

Compliance with Laws 

Each party shall perform all of its obligations under this notice in compliance at all times with all foreign, federal, state and local statutes, orders and regulations, including those relating to privacy and data protection.

Independent Contractor

Success Beyond Luck is providing to Client the Services as an independent contractor and nothing herein will create any association, partnership or joint venture between the parties hereto or any employer-employee relationship. Neither party may act for or on behalf of or in the name of the other party.

Right to Subcontract

Success Beyond Luck may use third party supplier or other provider of computer technology, financial expertise, advisement, or related services (“Subcontractor”) to perform part of the Services. Success Beyond Luck will be responsible for the performance of Subcontractors and their compliance with this notice. 

Waivers

Any waivers or amendments shall be effective only if made in writing signed by a representative of the respective parties. 

Alternative Dispute Resolution

In the event that any dispute arises, we both agree that we will submit the dispute to binding arbitration. Arbitration will be conducted under the commercial dispute resolution rules of the American Arbitration Association. Unless otherwise agreed by the parties, each party will choose an independent arbitrator, and those arbitrators will agree upon a third independent arbitrator who will act as the sole arbitrator for purposes of resolving the dispute. The arbitration will be conducted in Seattle, Washington. Nothing in this provision will prevent either party from obtaining injunctive relief in any court having jurisdiction over the matter.

Governing Law

This disclaimer notice will be deemed to have been made in, and shall be construed pursuant to the laws of the State of Washington and the United States without regard to conflicts of laws provisions thereof.
